These terms govern use of the Hypeit Solutions pay-per-call network by advertisers, publishers, and site visitors. They are written to be read — please review them before working with us.

1. The Service

Hypeit Solutions LLC ("Hypeit," "we," "us") operates a pay-per-call network that connects advertisers with consumers who place inbound calls in response to marketing campaigns, and delivers those calls — or live warm transfers — to advertisers under agreed qualification criteria and pricing.

These Terms & Conditions govern your use of our websites and services. By submitting an inquiry, signing an insertion order, or otherwise using our services, you agree to these terms. Specific campaign terms (pricing, qualification criteria, geography, and volume) are set out in a separate insertion order or campaign agreement, which controls in the event of a conflict.

2. Advertiser Obligations

Advertisers agree to handle all calls professionally and lawfully, to honor the qualification criteria and billing rules defined in their campaign agreement, and to maintain any licenses required to sell or service the products discussed on delivered calls (including state insurance licenses where applicable).

Advertisers are responsible for their own conduct on delivered calls, including their own TCPA, TSR, and state-law compliance once a call is connected. Advertisers may not record, resell, or redistribute consumer information obtained through our network except as permitted by their agreement with us and applicable law.

Billing is based on qualified calls as measured by our call-tracking platform, which serves as the system of record for call duration, source, and disposition. Disputes must be raised within the window stated in your campaign agreement, and call recordings are available to resolve them.

3. Publisher Obligations

Publishers may promote Hypeit campaigns only through traffic sources and methods approved in writing. All publisher marketing must comply with the TCPA, DNC registry requirements, CAN-SPAM, and applicable state telemarketing and consumer-protection laws.

Publishers must obtain and document valid consumer consent where required, must not use misleading, deceptive, or incentivized creative, and must not engage in robocalling, SMS blasting, or co-registration unless expressly approved. We monitor traffic quality and compliance continuously and may suspend or terminate any publisher immediately for violations, with unpaid earnings forfeited where traffic was non-compliant or fraudulent.

4. Compliance Standards

Compliance is a condition of doing business with Hypeit, for advertisers and publishers alike. All parties must comply with the Telephone Consumer Protection Act, the Telemarketing Sales Rule, Federal Trade Commission regulations, state mini-TCPA statutes, and Do-Not-Call registry requirements.

All calls on the network may be recorded and monitored for quality and compliance, as described in our Privacy Policy. We reserve the right to audit campaigns, request consent documentation, and pause any campaign or traffic source that presents compliance risk.

5. No Long-Term Commitment; Termination

Unless a campaign agreement states otherwise, there are no sign-up fees and no long-term contracts. Either party may pause or end a campaign with the notice period stated in the applicable insertion order. We may suspend service immediately for non-payment, compliance violations, or fraud.

6. Disclaimers and Limitation of Liability

Our services are provided "as is." While we design campaigns for high intent and verify qualification criteria, we do not guarantee any particular conversion rate, revenue outcome, or volume of calls. To the maximum extent permitted by law, our aggregate liability arising from the services is limited to the amounts paid to us (or payable by us) under the applicable campaign in the three months preceding the claim.

Neither party is liable for indirect, incidental, special, or consequential damages, including lost profits, arising out of the services.

7. General

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Travis County, Texas. If any provision is found unenforceable, the remainder stays in effect. We may update these terms from time to time; material changes will be posted here with an updated effective date.
